1. Acceptance of These Terms

These Terms of Service ("Terms") are a binding agreement between you and Pharmacy Brasil Las Americas Boca LLC ("Pharmacy Brasil," "we," "our," or "us"; full legal entity details are listed in the Company Information section at the end of this page), a pharmacy licensed by the Florida Board of Pharmacy. By accessing pharmacybrasil.com or using our services, you accept these Terms. If you do not agree, do not use the services.

2. Eligibility

To use our services, the following requirements apply:

• You must be at least 18 years of age.
• Prescription orders and pharmacy services are available only to individuals physically located in the State of Florida. We dispense only in Florida. Orders are picked up at our Boca Raton or Pompano Beach pharmacy.
• You must provide accurate, current, and complete information, including your health information, and keep it updated.

3. Our Services

Through our website you may: (a) purchase over-the-counter products; (b) order prescription medications, subject to prescription verification; (c) book a visit with our healthcare team at our Boca Raton location if you do not hold a current prescription for an eligible medication; and (d) book in-person appointments at our pharmacy locations. All medications are dispensed by our licensed Florida pharmacy.

4. Prescription Medications

A valid prescription issued by a licensed prescriber is required for all prescription medications. Depending on the medication, you may provide it by:

• Uploading a copy or photograph of your current, valid prescription;
• For certain chronic medications, providing proof of current use (such as a copy of a prior prescription or a photograph of your current medication label), subject to pharmacist verification;
• Having your prescriber send an electronic prescription to our pharmacy, or a fax to 1-754-306-0157;
• Completing a telehealth evaluation, where a licensed healthcare provider will determine, in their sole professional judgment, whether a prescription is appropriate (see Consent to Telehealth Services).

All prescription orders are reviewed and verified by a licensed pharmacist before dispensing. We may contact you or your prescriber to verify a prescription. We reserve the right, consistent with professional judgment and applicable law, to refuse to fill any prescription.

5. Controlled Substances

We do not dispense controlled substances through this website.

6. Product and Health Information

All medications we dispense are FDA-approved products obtained from licensed manufacturers and distributors. Product images are for reference only; actual packaging, tablet size, and color may differ. Information on our website — including information provided by our chat assistant — is provided for educational purposes only and is not medical advice, diagnosis, or treatment. Always consult your pharmacist, physician, or other qualified healthcare provider with questions about a medical condition or medication.

7. Orders, Pricing, and Payment

The following terms apply to orders, pricing, and payment:

• Prices are stated in U.S. dollars and may change without notice. We may correct pricing or listing errors, including after an order is placed, in which case you may cancel the affected order.
• When you place an order, an authorization hold is placed on your payment method. Your payment is captured only after your order has been verified and approved for dispensing. Orders containing only over-the-counter products may be charged upon processing.
• You may cancel an order at any time before it has been verified and prepared for pickup. Prescription medications cannot be returned or exchanged once dispensed. See our Pickup & Returns Policy.

8. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.

9. Prohibited Conduct

You agree not to engage in any of the following conduct:

• Providing false, misleading, or incomplete information, including health information or prescriptions;
• Obtaining or attempting to obtain medication for another person without lawful authority;
• Reselling or redistributing any medication purchased through the services;
• Interfering with the operation or security of the website;
• Using the services in violation of any applicable law.

10. Medical Emergencies

Our services are not intended for medical emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately.

11. Intellectual Property

The website and its content, including text, graphics, logos, and images, are owned by or licensed to us and are protected by intellectual property laws. You may not reproduce or exploit them without our prior written consent.

12. Disclaimers

Except as expressly stated in these Terms and to the fullest extent permitted by law, the website and services are provided "as is" and "as available," without warranties of any kind, whether express or implied. Nothing in this section limits the professional duties of our pharmacists and healthcare providers under applicable law.

13. Limitation of Liability

To the fullest extent permitted by law, our total liability arising out of or relating to the services shall not exceed the amount you paid for the order giving rise to the claim, and we shall not be liable for indirect, incidental, special, or consequential damages. This limitation does not apply to liability that cannot be limited under applicable law, including liability arising from professional negligence in the practice of pharmacy or medicine.

14. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your breach of these Terms, your unlawful use of the services, or false information you provide.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute shall be resolved in the state or federal courts located in Broward County, Florida.

16. Changes to These Terms

We may update these Terms from time to time. Continued use of the services after changes are posted constitutes acceptance of the updated Terms.
