Notice of privacy practices

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

1. Who We Are

This Notice is issued by Pharmacy Brasil Las Americas Boca LLC ("Pharmacy Brasil," "we," "our," or "us"; full legal entity details are listed in the Company Information section at the end of this page), a pharmacy licensed by the Florida Board of Pharmacy, with locations in Boca Raton and Pompano Beach, Florida. It applies to health information created or received by our pharmacy and by healthcare providers delivering services through us.

2. Our Duties

We are required by law to maintain the privacy and security of your Protected Health Information (PHI), to provide you with this Notice of our legal duties and privacy practices, to follow the terms of the Notice currently in effect, and to notify you if a breach occurs that compromises the privacy or security of your PHI.

3. How We May Use and Disclose Your PHI Without Your Authorization

We may use and disclose your PHI without your written authorization for the following purposes:

Treatment: to dispense your medications, verify prescriptions with your prescriber, provide pharmacist counseling, provide pharmacy services and in-person visits with our healthcare team, and coordinate your care with other healthcare providers.
Payment: to process your payments and conduct billing activities.
Healthcare operations: to run our pharmacy, conduct quality reviews, train staff, and manage our services.
Refill and treatment reminders: to contact you about refills, prescription status, or treatment alternatives.
As required by law: including reporting required by federal or Florida law.
Public health activities: such as reporting adverse drug events or product recalls.
Health oversight: to agencies such as the Florida Board of Pharmacy for audits, inspections, and licensing.
Judicial and administrative proceedings: in response to a court order, subpoena, or lawful process.
Law enforcement: as permitted or required by law.
To avert a serious threat to health or safety.
Workers' compensation: as authorized by law.

4. Uses and Disclosures Requiring Your Written Authorization

We will obtain your written authorization before: (a) using or disclosing your PHI for marketing purposes; (b) selling your PHI (which we do not do); or (c) making any other use or disclosure not described in this Notice. You may revoke an authorization at any time in writing, except to the extent we have already relied on it.

5. Your Rights

You have the following rights regarding your PHI:

Right to access: you may inspect and obtain a copy of your pharmacy records, in paper or electronic form. We may charge a reasonable, cost-based fee.
Right to amend: you may request that we amend your records if you believe they are incorrect or incomplete. We may deny the request in certain cases, and will explain why.
Right to an accounting of disclosures: you may request a list of certain disclosures we have made of your PHI.
Right to request restrictions: you may request restrictions on how we use or disclose your PHI. We are not required to agree, except where you pay for an item or service in full out of pocket and request that we not disclose it to your health plan.
Right to confidential communications: you may request that we contact you in a specific way or at a specific location.
Right to a paper copy of this Notice, even if you agreed to receive it electronically.
Right to be notified of a breach affecting your PHI.

6. Complaints

If you believe your privacy rights have been violated, you may file a complaint with us at legal@pharmacybrasil.com or with the U.S. Department of Health and Human Services, Office for Civil Rights. You will not be penalized or retaliated against for filing a complaint.

7. Changes to This Notice

We reserve the right to change this Notice and to make the revised Notice effective for PHI we already hold. The current Notice will always be posted on our website and available at our pharmacy locations.
